Welcome to Laria Dispatcher. These Terms of Service ("Terms") govern your access to and use of the Laria Dispatcher website at lariadispatcher.com (the "Site") and our truck dispatch services (collectively, the "Services"). By accessing or using our Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Definitions

For purposes of these Terms:

• "Company," "we," "our," or "us" refers to Laria Dispatcher.
• "Carrier," "you," or "your" refers to the owner-operator, motor carrier, or fleet engaging our dispatch Services.
• "Services" refers to freight dispatching, load sourcing, rate negotiation, back-office support, and related offerings provided by Laria Dispatcher.
• "Site" refers to lariadispatcher.com and all associated pages.

2. Description of Services

Laria Dispatcher provides freight dispatch services to owner-operators and motor carriers. Our Services include but are not limited to:

• Sourcing and presenting available freight loads from third-party brokers and load boards
• Negotiating freight rates with brokers on your behalf
• Managing carrier packets, broker setups, and related documentation
• Coordinating rate confirmations, invoice submissions, and factoring arrangements
• Providing route planning and scheduling recommendations
• Offering ongoing dispatch support and communication

3. Carrier Responsibilities

As a carrier engaging our Services, you agree to:

• Maintain active and valid motor carrier (MC) authority with the FMCSA
• Maintain required insurance coverage including liability and cargo insurance
• Provide accurate and complete documentation (W-9, COI, authority) upon request
• Comply with all applicable federal, state, and local laws and regulations
• Operate your equipment safely and in compliance with DOT regulations
• Review and approve all loads before acceptance; you retain final decision-making authority
• Notify us promptly of any changes to your insurance, authority, or operational status

4. No Forced Dispatch

Laria Dispatcher operates under a strict no-forced-dispatch policy. We present load options and rate recommendations; you retain the sole and absolute right to accept or decline any load. You are under no obligation to accept any load presented by us. Our role is advisory — we source, negotiate, and recommend, but the final decision is always yours.

5. Payment & Fees

Our dispatch fees are charged on a flat weekly rate basis as mutually agreed upon between you and Laria Dispatcher. Specific pricing terms, billing cycles, and payment methods will be established during your onboarding and documented in your service agreement.

Laria Dispatcher does not deduct fees from your freight settlements. You are responsible for paying our dispatch fees according to the agreed-upon schedule, independent of your load settlements from brokers or factoring companies.

6. Broker Relationships & Load Performance

Loads presented by Laria Dispatcher are sourced from third-party freight brokers and load boards. We exercise reasonable care in vetting brokers and loads, but we do not guarantee broker creditworthiness, payment timelines, or load accuracy. You are encouraged to perform your own due diligence on brokers and loads.

You are solely responsible for the safe and timely transportation of freight once a load is accepted. Laria Dispatcher is not liable for claims arising from late delivery, cargo damage, accidents, or any other incidents related to the physical transportation of freight.

7. Intellectual Property

The Site and its original content, features, and functionality — including but not limited to text, graphics, logos, images, and software — are owned by Laria Dispatcher and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Laria Dispatcher and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or Services, including but not limited to lost profits, lost revenue, business interruption, or damage to reputation.

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the dispatch fees paid by you to Laria Dispatcher in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any particular freight rates, load availability, or revenue outcomes will be achieved. Any reliance you place on information provided through our Services is strictly at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless Laria Dispatcher and its officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Services, your violation of these Terms, or your violation of any applicable law or regulation.

11. Termination

Either party may terminate the dispatch services relationship at any time, with or without cause, upon notice to the other party. There is no long-term commitment or minimum contract period — you are free to discontinue our Services at any time.

We reserve the right to terminate or suspend access to our Site and Services immediately, without prior notice, for any conduct that we determine, in our sole discretion, violates these Terms or is harmful to Laria Dispatcher, other carriers, or third parties.

12. Third-Party Links & Services

Our Site may contain links to third-party websites or services that are not owned or controlled by Laria Dispatcher. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that Laria Dispatcher shall not be liable for any damage or loss caused by your use of any third-party content, goods, or services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Pennsylvania.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site and Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.
